Federal jury convicts Bay City sex offender accused of having 300 images of child porn

BAY CITY, MI — Eight years ago, Bay Citian Justin W. Zube was sentenced to state prison for possessing child pornography. It was his second sex-related offense, and a prosecutor at the time expressed doubt that Zube would change.

“He doesn’t seem to have learned from that and there’s no indication he’ll necessarily learn in this instance,” said Bay County Chief Assistant Prosecutor Jeffrey D. Stroud when Zube was sentenced in August 2014.

Released from prison, Zube proved Stroud’s concerns valid, as authorities soon found Zube had amassed more child porn and nearly 50 videos he seemingly recorded of people using restrooms. As a result, he’s now been convicted on the federal level and facing a lengthy sentence.

A federal jury on Monday, April 11, found the 34-year-old Zube guilty of possessing or accessing child porn. The charge is punishable by 10 to 20 years in prison and a fine of $250,000, though Zube’s priors may increase the penalty.

The trial began March 23.

Zube’s federal case began when the National Center for Missing & Exploited Children on Dec. 7, 2019, received a cyber tip from photo-sharing app Snapchat that an account had uploaded child porn. Investigators subsequently linked the profile’s subscriber information and IP address to Zube.

FBI agents then executed a search warrant on Zube’s home and seized his electronic devices, finding on them more than 300 image of child porn. At least four of the children had been identified by the time of Zube’s arraignment on Oct. 21, 2020.

In addition to the child porn, Zube had 48 videos he had seemingly surreptitiously recorded of people using restrooms.

Zube has more than 10 criminal convictions. His convictions include breaking and entering a vehicle, breaking and entering with intent to commit a larceny, loitering in a student safety zone, domestic violence, attempted possession of a firearm by a felon, larceny, and receiving and concealing stolen property.

In August 2014, Bay County Circuit Judge Harry P. Gill sentenced Zube to 23 months to four years in prison, with credit for 88 days already served. Two months prior, Zube pleaded no contest to one count of possession of child sexually abusive material.

The Michigan Department of Corrections released Zube on May 7, 2018, after he had served the full term of his 2014 sentence. Zube had not been paroled before being discharged.

Zube was also adjudicated as a juvenile in 2002 of fourth-degree criminal sexual conduct for assaulting a younger male relative.

Zube in February 2020 was arraigned on the state level in Bay County District Court on a charge of failure to comply with his sex offender reporting duties. Zube in November pleaded guilty to failing to pay his registration fee and was fined $150, which he still owes.

While free on bond, Zube in August 2020 was allegedly involved in a stabbing in Bay City’s Wenonah Park. No charges were filed against him and he stated on social media he acted in self-defense.

U.S. District Judge Thomas L. Ludington, who presided over Zube’s trial, is to sentence him at 3 p.m. on Aug. 4.
